W praktyce klinicznej stosowane są leki, które są zarejestrowane w danym wskazaniu – posiadają pozwolenie na dopuszczenie do obrotu i wskazanie wpisane w Charakterystyce Produktu Leczniczego. Zdarza się jednak, że lek, który ma bardzo obiecujące wyniki zdrowotne jest jeszcze w fazie badań klinicznych lub w trakcie procedury rejestracyjnej w danym wskazaniu. W przypadku części chorób można w takim przypadku poczekać na rejestrację leku, jednak w przypadku chorób zagrażających życiu, przewlekłych lub prowadzących do poważnej niepełnosprawności, istotną kwestią jest jak najszybszy dostęp chorego do leczenia. Często zdarza się, że jest to jedyna obiecująca terapia w danej jednostce chorobowej. Prawo polskie przewiduje wyjątki umożliwiające dostęp do leczenia przed jego zarejestrowaniem. Mechanizmy dostępu do niezarejestrowanych metod leczenia w Polsce obejmują: badania kliniczne, czasową zgodę na dopuszczenie do obrotu leku niezarejestrowanego, compassionate use, import docelowy.

Mechanisms of access to unregistered methods of treatment in Poland 

In clinical practice, drugs are used that are registered in a given indication – they have a marketing authorization and an indication set out in the Summary of Product Characteristics. It happens, however, that a drug that has very promising health outcomes is still in the phase of clinical trials or during the registration procedure in a given indication. In the case of some diseases, you can wait for the drug to be registered, however, in the case of life-threatening diseases, chronic or leading to serious disability, the most important thing is to have access to the treatment as soon as possible. Often, it is the only promising therapy in a given disease entity. Polish law provides for exceptions allowing access to treatment before its registration. Mechanisms of access to unregistered methods of treatment in Poland include: clinical trials, temporary approval for admission to the market of an unregistered drug, compassionate use, and target import.
