Przedmiotem niniejszej pracy jest dokonanie przeglądu zakresu odpowiedzialności farmaceuty świadczącego usługi farmaceutyczne w aptece ogólnodostępnej, zakładowej i szpitalnej. Realizacja założonego celu wymaga ustalenia prawnych obowiązków oraz kompetencji aptekarza w kontekście udzielonych lub wykonanych usług o charakterze dystrybucyjnym, wytwórczym i informacyjnym, a następnie dokonania analizy skutków zaniechania lub braku staranności zawodowej. Praca w sposób wyczerpujący opisuje sytuację prawną aptekarza, a wnioski z niej płynące pozwalają na sformułowanie postulatów de lege ferenda.

The pharmacist’s responsibility for the provided pharmaceutical service. Part I

The subject matter of this paper is to review the scope of responsibility of the pharmacist providing pharmaceutical services at a community, company and hospital pharmacy. To attain the set goal, it is necessary to establish the legal responsibilities and competences of the pharmacist in the context of the provided or completed services of distribution, production and informational nature, and then to analyze the consequences of omission or lack of professional diligence. The paper exhaustively describes the legal situation of the pharmacist and the conclusions drawn from this permit de lege ferenda proposals to be formulated.
