Ochrona prawna własności intelektualnej pełni ważne funkcje zarówno dla całej gospodarki, jak i dla pojedynczych przedsiębiorstw, wchodząc w skład kapitału niematerialnego. Celem artykułu jest omówienie zagadnienia własności intelektualnej w kontekście przemysłu farmaceutycznego.

W realizacji celu autorzy zaprezentowali rodzaje własności intelektualnej, zależności i uwarunkowania jej istnienia, korzyści z niej wynikające, a także metody wyceny i zarządzania własnością intelektualną.

W dalszej części opisano procedury opatentowania leków i ich przepakowywania w ramach importu równoległego. Zwrócono uwagę na ochronę i naruszenia własności intelektualnej w trakcie tych procesów oraz przedstawiono wynikające z nich korzyści i straty dla różnych podmiotów.

Legal protection of intellectual property has important functions both for the economy as a whole and for individual companies as a part of intangible capital. The aim of this paper is to discuss intellectual property issue in the context of the pharmaceutical industry. For this purpose, authors will present the types of intellectual property, relationships and circumstances of its existence, its benefits, and in addition methods of valuation and management of intellectual property. Patenting and repackaging drugs procedures in the field of parallel trade will be described in the next section of this paper. Attention will be paid to the protection and infringement of intellectual property during these processes. The benefits and wastes for different entities resulting from them will be also presented.
